Asylum

People seeking asylum in the United States are typically fleeing their native country on account they have been persecuted or they fear persecution due to many reasons, including race, nationality, religion, political opinion, or membership in a particular social group. In order to be considered for asylum, you must file Form I-589, Application for Asylum and for Withholding of Removal. You may fill out the form and apply for asylum if you are physically in the United States and are not a U.S. citizen.

When you file for asylum, you may include your spouse and children who are currently living in the United States in the initial filing or any time before the final decision is made. Children must be unmarried and under 21 years old in order to be included in the application.

Asylum laws are always changing. It is important to submit an initial filing as complete and correct as possible to ensure success.
